1. Who I am
galinir.com and the services offered on it are provided by Gali Nir, an exempt dealer (Osek Patur), Tel Aviv, Israel. Contact: gali.nir@gmail.com
2. Using the website
You are welcome to browse the website and contact me through it. You may not copy, distribute or commercially use content or photographs from the website without written permission. You may not attempt to disrupt the website or access its admin panel.
3. Services
- Website building: designing and building websites with AI tools (Vibe Coding).
- AI design: custom images created with artificial intelligence, such as animation-style portraits, anthropomorphized pets and illustration-style images.
- Photography: portraits of people and pets, nature photography and portfolio shoots, including editing in Lightroom and/or Photoshop.
The scope, deliverables, schedule and price of each project are set in a written quote. Anything not listed in the quote is not included. The quote prevails over these terms, unless it would reduce a right the law grants to a consumer.
4. Price and payment
- The price in the quote is the final price. As an exempt dealer, I do not charge VAT.
- Payment terms and methods are set out in the quote. As a rule: a 50% deposit at the start of work and the balance on delivery.
- A receipt is issued for every payment.
- Third-party costs, such as a domain, hosting, tool subscriptions or travel for shoots outside the central region, are not included unless the quote says otherwise.
5. Delivery
Deliverables are provided as set in the quote: a link to the website, a transfer to the client's account, or digital files. Photo sessions take place at a location chosen by the client or outdoors, on a scheduled date. Schedules also depend on receiving materials and feedback from the client on time.
6. Cancellation
A client who is a consumer (ordering a service for personal rather than business use) and who entered into the transaction remotely (by phone, email or the website) may cancel it under section 14C of the Israeli Consumer Protection Law, 1981:
- Within 14 days of the transaction or of receiving the document with the transaction details, whichever is later.
- For a service given on a specific date, such as a photo session, the cancellation must arrive at least 2 business days (excluding days of rest) before the service date.
- Senior citizens, persons with disabilities and new immigrants, as defined by law, may cancel within 4 months, where the transaction included a conversation between the parties (including electronic communication), subject to the conditions in the law.
- How to cancel: by email to gali.nir@gmail.com, with your full name and the transaction details.
- Refund: within 14 days of receiving the cancellation notice, minus a cancellation fee of 5% of the price or ILS 100, whichever is lower. No cancellation fee is charged when the cancellation is due to a defect, a mismatch or a failure to deliver on time.
A business client may cancel as set out in the quote. As a rule: the client may cancel at any stage and will pay for the work done up to the cancellation date; the deposit is non-refundable.
7. Materials provided by the client
The client is responsible for having the right to use any material they give me (texts, logos, images), and for ensuring that everyone who appears in images they provide has agreed to their use. Images sent for AI design are processed with third-party AI tools, as described in the Privacy Policy.
8. Intellectual property
- Websites and designs: once full payment is received, the client receives the rights in the deliverables provided, as set out in the quote. Third-party components (fonts, code libraries, templates, stock images) are subject to their own licenses.
- Photographs: copyright ownership and terms of use for photographs are set in the quote. Unless otherwise agreed, the Israeli Copyright Act, 2007 applies, including section 35 regarding a commissioned portrait or photograph of a family event for private use.
- Portfolio: I may show websites and designs I built on my website and social media accounts, unless the client asks otherwise in writing. Photographs showing people will be shown only with the explicit and separate consent of the people photographed, and for minors - of a parent.
- AI output: copyright protection for content created with artificial intelligence is uncertain. A design "in the style of" a particular studio or artist is inspiration only, and is not affiliated with or endorsed by that studio or artist.
9. Liability
I undertake to perform the work professionally and as set out in the quote. I am not responsible for failures of external providers (hosting, platforms, AI tools), for content provided by the client, or for changes made to the website by the client or others after delivery. AI output may contain inaccuracies, and I review it before delivery. In the event of damage, my liability is limited to the amount paid to me for that work. Nothing in this section limits liability that cannot be limited by law, or rights the law grants to a consumer.
10. Minors
Transactions are entered into by adults. Photography of a minor takes place only at the request and with the consent of a parent.
11. Privacy and accessibility
The use of personal data is described in the Privacy Policy, and the website's accessibility is described in the Accessibility Statement.
12. Governing law and jurisdiction
These terms are governed by Israeli law. In a dispute with a business client, the competent courts in Tel Aviv-Jaffa have jurisdiction. Nothing in this section denies a consumer the right to bring a claim in the court that has jurisdiction under law.
13. Changes
I may update these terms from time to time. An update applies only to transactions made after it, and the update date appears at the top of this page.
